TAIPEI - In 2020, the U.S. Bureau of Industry and Security (BIS) added Taipei’s Xunwei Technologies Co., Ltd. (訊崴技術有限公司) to a long list of sanctioned Huawei Non-U.S. Affiliates.
For all items subject to the EAR, see §§ 736.2(b)(3)(vi), and 744.11 of the EAR [Export Administration Regulations], EXCEPT for technology subject to the EAR that is designated as EAR99, or controlled on the Commerce Control List for anti-terrorism reasons only, when released to members of a “standards organization” (see § 772.1) for the purpose of contributing to the revision or development of a “standard” (see § 772.1).
To further damage Xunwei, in 2020 the U.S. implemented the Foreign Direct Product Rule that restricts both U.S. and non-U.S. companies from shipping items to Huawei that are the direct product of U.S. technology or software.
